At least 1000 or more residents of Kasanje Town Council in Bukalaza cell, Wakiso District are affected by the forceful illegal eviction by a one Ruta Sabastian Ngambwa, a proprietor of Prime Estates Limited.
The affected residents are Bibanja owners, majority of whom have spent over four decades on the contested land.
Those severely affected families are from the village of Bukalaza including the zones of Kijona, Kolombe and Kasasa.
With no legal binding documentations, notice of eviction and a court order, these residents were forcefully evicted by Edgar Ahabwe, working on the command of Ngambwa with protection of the Kasanje area Officer in Charge and a group of youth (goons).
It is believed that the Local Council Chairperson Chrisetome Muganga and Nickolas Masakwa have helped precipitate these evictions since they assisted some residents (hoodwinked) get the forged land titles in 2019.
The residents have since appealed to the office of the Entebbe Deputy Resident District Commissioner (DRC) Frank Kyazze.
“We seek for justice against the illegal evictions. This is the land where we have been for more than 40 years. It is farming land, we stay here and we shall be deemed homeless with the evictions” one of the affected residents speak out.
Background:
Gateway News has established that the Ngambwa acquired this land that measures one square milo from the sons of the late Mubiru Lubato, who was a son of the late Alexander Nidwala Gbaunga.
This land had been lawfully offered to the heir of the late Gabunga Susani Kasozi, with the available documents providing the status through a will left behind.
Alex Bulyera Muyinza, now a resident of Lubaga in Kampala is one of the surviving daughters of Susani Kasozi, the right beneficiary of the father’s share.
It has been revealed that Muyinza registered the powers of attorney over this disputed land in 2005 (Administration cause no. 854 of 2005 high court of Uganda of Kampala).
While the sons of the late Mubiiru Lubato got powers of attorney over their father’s property in 2017.
They allegedly used the powers of attorney to sell off this one square milo of Susani Kasozi to Ngambwa unlawfully.
This prompted Muyinza to drag them to the High Court in Makindye over the said land amid a family dispute.
On 3rd September 2022, court made its judgment, that all transactions and land titles that had been issued were declared null and void.
This ruling temporarily brought calmness to the bibanja holders and Muyinza.
With the intervention of General Muhoozi, these bibanja holders have the hope that situation will be well handled and justice delivered to the dot.
