The High Court in Masaka has fixed September 30 and October 1 for the continuation of the election petition challenging Justine Nameere’s victory as Masaka City Woman MP.
Justice Bernard Namanya adjourned the proceedings after allowing video evidence tendered by National Unity Platform (NUP) candidate Rose Nalubowa’s lawyers to form part of the court record.
Nalubowa filed the petition contesting Nameere’s victory in the parliamentary election.
The dispute has included questions surrounding the results and the subsequent recount that altered the initial outcome.
During the proceedings, lawyers representing Nameere, led by Sam Ssekyewa, objected to the video evidence presented by the petitioner.
The defence also raised objections to an affidavit sworn by Deogratious Bukenya, arguing that he lacked the required court authorisation and expertise to give evidence on the matters contained in the affidavit.
After considering the objections, the court admitted the video evidence into the record, clearing the way for the petition to proceed.
The petition will now return for further hearing, with cross-examination of witnesses expected to continue on the newly scheduled dates.
Nameere’s legal team is expected to challenge the evidence relied upon by Nalubowa, while the petitioner’s lawyers will continue presenting evidence in support of their challenge to the election outcome.
The Electoral Commission and the Masaka City Returning Officer are also respondents in the proceedings.
The case remains before Justice Namanya, who will consider the evidence presented by both sides before making a determination on the petition.
